By purchasing, downloading, installing, or using Whisper Dictation ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

2. License Grant

Upon purchase, you are granted a non-exclusive, non-transferable, perpetual license to use Whisper Dictation on your personal Mac computer(s) for personal or commercial purposes.

This license permits you to:

• Install and use the Software on any Mac computers you own or control
• Use the Software for any lawful purpose, including commercial use
• Receive free updates to the Software as they become available

3. Restrictions

You may NOT:

• Redistribute, sell, lease, or sublicense the Software
• Reverse engineer, decompile, or disassemble the Software
• Remove or alter any proprietary notices or labels
• Use the Software for any illegal purpose
• Share your license with others outside your household

4. Intellectual Property

Whisper Dictation and all related materials are protected by copyright and other intellectual property laws. The Software incorporates OpenAI's Whisper model, which is used under the MIT License.

You retain full ownership of any content you create using the Software. We claim no rights to your dictated text or any works you produce.

5. Payment and Refunds

Pricing

Whisper Dictation is sold as a one-time purchase of $19 USD. There are no recurring fees or subscriptions.

Payment Processing

All payments are processed securely through Gumroad. We do not have access to your full payment details.

6. Software Updates

We may release updates to the Software from time to time. These updates are provided free of charge and may include bug fixes, performance improvements, and new features. Updates are optional but recommended.

7. System Requirements

The Software requires:

• macOS 12 (Monterey) or later
• Apple Silicon (M1/M2/M3/M4) or Intel processor
• Minimum 8GB RAM
• Approximately 2GB available storage

We do not warrant that:

• The Software will meet your specific requirements
• The Software will be uninterrupted or error-free
• Transcription accuracy will be 100% in all situations
• The Software will be compatible with future macOS versions

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Software
• Any errors or inaccuracies in transcription
• Any unauthorized access to your data (noting that the Software does not transmit data)
• Any other matter relating to the Software

Our total liability shall not exceed the amount you paid for the Software ($19 USD).

10. Indemnification

You agree to indemnify and hold harmless Whisper Dictation and its creators from any claims, damages, losses, or expenses arising from your use of the Software or violation of these Terms.

11. Termination

Your license to use the Software continues indefinitely unless terminated. We may terminate your license if you violate these Terms. Upon termination, you must cease all use of the Software and destroy any copies in your possession.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the Software after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
